But in the end he also says all of the riders contracts have been/will be terminated so they are/will be free agents

the riders are probably in the right to view the contracts as terminated for the reasons you stated, however they'd likely need lawyers to avoid any legal liability if they were to just walk away / sign with another team right now. the season is in its final 2 weeks with back to back races, and I'm sure the riders / their agents (if any) have neither the time / interest / funding to pick that fight right now. another likely factor would be how long they have left on their contract. the other aspect separate from any contract breach...

At least for this year the points are calculated at the end of October. So any rider on a team adds their entire years worth of points, which means mid season transfers count toward the new teams total.

I think this just an artifact of Dak being the only Mondraker rider at the US Open. He probably doesn't mind racing the 'privateer' life for one event to be able to have his own personal van and dog with him for the remaining World Cup rounds. I'm sure he'll be back with the team in New York. I mean unless something really weird went down and even if he is ultimately leaving, he is under contract until the end of the year I would presume.
